1. Acceptance of Terms

By downloading or using FocusBun ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app. These Terms apply to all users of the app.

2. Description of Service

FocusBun is a task management app designed for teens with ADHD. It lets you create tasks with priorities and consequences, break them into timed focus sessions, and earn streaks, points, and badges for completing work. Your tasks, preferences, and rewards are stored locally on your device. Core timer functionality works offline; analytics and crash reporting use an internet connection when available.

3. Price & Availability

FocusBun is a paid application sold as a one-time in-app purchase — product ID com.fundydigital.focusbun.pro, priced at US$5.99 (subject to local currency conversion and store fees). There is no subscription, no recurring charge, and no advertising. Once purchased, the product remains available to the purchasing account on all devices signed into the same Apple ID or Google Play account, including after reinstall, in accordance with Apple App Store and Google Play policies.

Grace period before purchase. To allow new users to evaluate the app before purchasing, the app provides an introductory access period of seven (7) days from the date of first launch on a device. During this period, all features are available without payment. After the seventh day, the app will require completion of the one-time purchase to continue use. This grace period is an app-managed convenience — it is not a StoreKit introductory free trial, is not an Apple-managed offer, and creates no recurring billing obligation of any kind. No payment method is collected during the grace period.

The current price is displayed on the purchase screen within the app and may vary by region. All purchases are processed by the Apple App Store or Google Play Store. Refund requests are handled by the respective store under that store's standard refund policy.

You agree not to:

• ✗ Reverse engineer, decompile, or disassemble the app.
• ✗ Use the app for any unlawful purpose or in violation of any applicable laws.
• ✗ Redistribute, sublicence, or resell the app or any part of it.

FocusBun and all related content, design, and code are owned by Fundy Digital and protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the app on devices you own or control, solely for personal, non-commercial use.

8. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Fundy Digital and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data or missed deadlines arising from use of the app.

10. Termination

We reserve the right to discontinue the app or any feature at any time. You may continue using any version you have downloaded for as long as your device supports it. We are not obligated to provide updates, new features, or ongoing support. If you have purchased FocusBun Premium, your one-time purchase entitlement remains valid for as long as the app is installed and functional on your device; discontinuation of the app does not entitle you to a refund.

FocusBun is distributed via the Apple App Store and Google Play Store. Apple and Google are not parties to these Terms and are not responsible for the app or its content. Any product liability claims, consumer protection claims, intellectual property infringement claims, or legal compliance claims are the sole responsibility of Fundy Digital.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Subject to Section 14 (arbitration), disputes shall be resolved in the courts of New York State. If you are a consumer, this does not deprive you of the protection of mandatory laws, or of the right to bring proceedings in the courts, of your country of residence.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Fundy Digital from claims, damages, and reasonable expenses arising out of your misuse of the app or your violation of these Terms or of applicable law. This does not apply to the extent a claim arises from our own breach, and it does not limit the mandatory rights of consumers.

14. Dispute Resolution; Binding Arbitration & Class-Action Waiver

Please read this section carefully — it affects how disputes are resolved. Except for disputes that qualify for small-claims court and except where prohibited by law, you and Fundy Digital agree to resolve any dispute relating to the app through binding individual arbitration administered under the rules of a recognized U.S. arbitration provider, seated in New York, rather than in court. You and Fundy Digital waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out by emailing [email protected] with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms. Consumers in the EU/EEA and UK: this Section does not apply to the extent your local law gives you the right to bring a claim in your local courts; your mandatory consumer rights are unaffected.

16. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when changes are made. Continued use of the app after changes are posted constitutes your acceptance of the revised Terms.
